South Dakota Rules of Civil Procedure — SDCL Chapter 15-6, Rule 4
Who May Serve: Under SDCL 15-6-4(c), process may be served by the sheriff of the county where the defendant is found, or by any other person not a party to the action who is an elector of the county in which service is made. Rushmore Process Services employs qualified servers who meet this requirement in every South Dakota county.
Methods of Service: Rule 4(d) authorizes personal delivery to the defendant, substituted service at the defendant's dwelling with a person of suitable age and discretion, or delivery to an authorized agent. For corporations, service must be made upon an officer, managing agent, or registered agent of the corporation. Service on the State of South Dakota is made upon the Attorney General.
Proof of Service: Under SDCL 15-6-4(g), proof of service must be filed with the court promptly. Our servers execute detailed affidavits of service that include the name of the person served, the date, time, and location, the method of service used, and a physical description of the person served when relevant. These affidavits are notarized and court-ready upon delivery to your office.
Service by Mail: SDCL 15-6-4(d)(8) permits service by mail when a defendant cannot be located for personal service. Certified mail with return receipt is the accepted method. However, personal service is always more defensible and carries the lowest risk of challenge.
